DEFINITION OF TERMS: The following terms you will encounter carries the following meaning: "Contract"- This means the first two pages of the Rental Agreement; "Lessee" - means the person who will be leasing or renting the vehicle as well as any other party allowed by Lessor based on the first page to operate the vehicle; "Lessor" - means the authorized car dealer that will be leasing or renting the vehicles as named in page 1; "Vehicle" - the truck, car, automobile, basically the vehicle as described, which is subject to each and every terms and provisions as of in this contract.
1. DRIVERS: There will be no excuses, no matter what, the vehicle rented shall not be operated, used or driven by any other person other than the Lessee, or any other additional Lessee who had signed the contract. Drivers shall not violate any terms on the contract. The vehicle shall be driven by any driver who is qualified as well as licensed, and twenty-one (21) years of age or older. Even if the person who will drive is the Lessee's employee, he or she needs to be assigned as an additional Lessee on the agreement.
2. PROHIBITED USE: Keep in mind, that the Vehicle at all times, shall not be used:
(1) In any activities which violates the local regulation, ordinance and law; (2) by any person who is currently under the influence of drugs, narcotics, alcohols and other intoxicants; (3) for hiring purposes in which the Lessee uses the vehicle to make money via transportation services; (4) for any competitive event, test or race; (5) to drive out of the state without having prior written consent from the Lessor; (6) by any person who are not specified as in paragraph 1 aforementioned; (7) by any person who are below the age of 21 years old; (8) for the purpose of pushing or towing any other vehicle, except for written permission beforehand by the Lessor which is subject to all conditions. Lessee is not allowed to install any sort of modification or trailer hitches such as bumpers, and clamp-on without permission from the Lessor. The Lessee shall not, no matter what, use the vehicles for profit, such as renting it out or releasing it to another party or person. If the vehicle is obtained by the Lessee by means of misrepresentation, fraud, or falsehood, the agreement is terminated and Lessee needs to return the vehicle immediately. As long as the vehicle is with the Lessee, all rules, regulations as well as terms and conditions should always be followed. Any damage to the vehicle during the period of loan in the hands of the Lessee and other additional drivers, Lessee should reimburse the company fully. Any loss caused by actions from the aforementioned "Prohibited Use" should also be reimbursed.
3. RETURN OF VEHICLE:
This contract is only for one rental. The vehicle is solely the property of the Lessor. Lessee must agree to return vehicle to Lessor according to the address as well as the date as displayed in page 1 (under the term, "Due Date") in the exact same condition like how it was received, excluding the ordinary wear and tear. Lessor, as well as all of its employees or agents must agree to peacefully repossess the vehicle without force or demands. Lessor have the rights to terminate the agreement if Lessee were to break any of the terms, such as doing any one of the prohibited conducts. Lessor have the rights to retrieve the vehicle peacefully from the Lessee if this were to happen. Lessor shall not in any way be responsible for any damages caused by Lessee, as well as any loss occurred while in hands of the Lessee, and Lessee needs to be liable for full reimbursement.
4.AMOUNTS DUE LESSOR:
Lessor shall be paid by Lesse on demand: (a) As shown on page 1, all the time and mileage charge based on the contract with the mileage based on the odometer installed in the vehicle. Lessee shall not, in any event, detach the installed odometer and shall pay if anything were to happen to it, for its repair or for its loss it the odometer is broken, loss, or missing its seal while the vehicle is in the hands of the Lessee; (b) Service, minimum or basic rate, Collision Damage Waiver, as well as any other charges as displayed on page 1 hereof; (c) Any liens, out of pocket expenses and penalties forfeiture court cost incurred by Lessor in regards that Lesse's use of the vehicle caused it, such as traffic violations, law violations, or any other events which requires payment which is directly under the fault of the Lessee. If it is based on Lessor's fault, this is excluded; (d) Lessors cost of expenses as well as attorney's fees if the vehicle used by the Lessee were to be involved with legal cases; (e) Lessors costs and expenses for the use of repairing the vehicle used by the Lessee which was damaged in accident, improper use, loss from theft, or any violations based on the Prohibited Use clause.
5. INDEMNITY: The Lessee does hereby agree to take all responsibility, indemnify and will not hold the Lessor responsible for any damage, losses, suits, claims, attorney fees, costs as well as any expense needed by Lessor due to the improper use of the vehicle by the Lessee or any other person while the vehicle is with the Lessee.
6. NO AGENCY: The Lessee, not any other drivers allowed to drive the vehicle shall not claim to be as an agent, servant, or employee of the Lessor for any purpose, especially for monetary gains during the term of this Agreement. Lessee holds full responsibility that the vehicle is loaned, at all times until it is returned.
7. REPAIRS: Lessee shall not allow any repair works, or modifications to be done to the vehicle, unless approved with written permission for the Lessor. Lessee shall be responsible for any repairs needed.
8. ACCIDENTS: Lessee have the responsibility to report any accident that happens while the vehicle is in the hands of the Lessee to the local law enforcement agency which holds jurisdiction of the location of the accident. Lessee shall also immediately report to the Lessor, and needs to deliver to the Lessor, if requested, any paperwork, process, pleasing notice, or any other documents needed. Lessee shall fully cooperate with the local law enforcement, the insurers as well as the Lessor during investigations.
9. CREDITS AND CHARGES: Lessee must agree to pay the charges and fee based on the agreement. If Lesse fails to make payments, Lessee will be in debt to the Lessor, with interest rate charged per month as set by Lessor. Lessee however must be liable and responsible to make any payments as swift as possible.
10. THEFT OF VEHICLE: Lessee shall be held responsible to a maximum of $1000 in case of vehicle theft, only if Lessee is able to return the company keys of the lost vehicle.
11. INSURANCE: The Lessor concurs to supply valid automobile liability insurance to the Lessee or the operator of the vehicle.
12. COLLISION DAMAGE WAIVER PROTECTION: This does not include flat tires, blowouts, damage to wheels, tires, or rims, broken glass, or any interior damage such as rips, cigarette burns, stains or tears to the carpet and upholstery, or any other damage, as well as missing inventories such as spare tire, floor mats, hub caps, jack, etc.
13. ENTIRE CONTRACT: This contract states the full understanding and agreement of both parties, and there are no other warranties, representations, conditions or collateral agreements.
14. CDW: Keep in mind that CDW will not cover you if an accident happens and you do not report it appropriately in time, as well as last minute reporting especially during time of return. Lessee will be fully responsible over any impound fees, damages, traffic citations as well as any traffic offense which needs to be settled. Lessee will be automatically charged, based on car type, and fee set by the Lessor.
15. All court cases will be held and tried in Miami-Dade County, State of Florida.
